Agreement to Terms

By accessing or using The Hiring Academy website and purchasing our products, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our website or purchase our products.

Products and Services

The Hiring Academy offers online educational courses and materials related to hiring practices for business owners. Course content is delivered through the Kajabi platform. Access to the course is granted upon successful payment and is subject to these terms.

Pricing and Payment

All prices are listed in US Dollars. Payment is processed securely through Kajabi's payment system. By making a purchase, you represent that you are authorized to use the payment method provided and that the information you supply is accurate and complete.

Refund Policy

We offer a 30-day money-back guarantee on all course purchases. If you are not satisfied with the course for any reason, contact us within 30 days of your purchase date for a full refund. Refunds will be issued to the original payment method within 5-10 business days. After 30 days, all sales are final.

Intellectual Property

All content on this website and within the course — including text, graphics, logos, images, video, audio, and course materials — is the property of The Hiring Academy and David Lee Jensen, and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

License to Use

Upon purchase, you are granted a limited, non-exclusive, non-transferable license to access and view the course content for your personal, non-commercial use. This license does not include the right to share your account, redistribute course materials, or use the content for commercial training purposes without a separate licensing agreement.

Disclaimer

The Hiring Academy provides educational content based on the experience and opinions of David Lee Jensen. Results may vary. We do not guarantee specific outcomes from using our system. The course is not a substitute for professional legal, HR, or employment counsel. You are responsible for ensuring your hiring practices comply with all applicable laws and regulations in your jurisdiction.

Limitation of Liability

To the fullest extent permitted by law, The Hiring Academy and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the website or course materials, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the course.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located in California.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page. Your continued use of the website after changes are posted constitutes acceptance of the revised terms.

Interactive Hiring Tools Disclaimer

The interactive tools, templates, scorecards, quizzes, scripts, and other resources (collectively, "Tools") provided on this website by The Hiring Academy, LLC ("THA," "we," "us," or "our") are offered solely for informational and educational purposes. They are designed to help users learn about and improve their hiring practices through self-guided exploration.

Not Professional Advice. The Tools and their outputs do not constitute legal advice, human resources advice, employment counseling, or any other form of professional advice. The Tools are not a substitute for the guidance of a qualified attorney, HR professional, or compliance specialist. You should consult with appropriate professionals before making any employment decisions.

No Employment Recommendations. The Tools do not make hiring, firing, promotion, or any other employment recommendations. Any scores, results, insights, or outputs generated by the Tools are educational in nature and are not intended to direct, instruct, or recommend any specific employment action regarding any individual candidate or employee. The Hiring Academy, LLC exercises no control over your specific hiring practices or employment decisions implemented using or informed by the Tools.

No Disparate Impact Warranty. THA does not warrant or represent that use of the Tools will result in hiring practices that are free from disparate impact or adverse impact on any protected group. You are solely responsible for ensuring that your hiring practices, including any practices informed by the Tools, comply with EEOC guidelines and all applicable anti-discrimination laws.

Not a Selection Procedure. The Tools are not designed, intended, or validated as employment selection procedures, pre-employment tests, or automated employment decision tools as those terms are defined under federal, state, or local law. The Tools should not be used as the sole or primary basis for any employment decision.

No Guarantee of Outcomes. THA makes no guarantees, representations, or warranties regarding the effectiveness of the Tools or the quality of any hiring decisions made using or informed by the Tools. The Tools are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

Limitation of Liability. To the fullest extent permitted by applicable law, The Hiring Academy, LLC, its owners, officers, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to: (a) your use of or reliance on the Tools or their outputs; (b) any hiring, termination, or other employment decision made using or informed by the Tools; (c) any claim of employment discrimination, wrongful termination, or other employment-related claim brought by any third party; or (d) any failure of the Tools to comply with any applicable law or regulation.

Indemnification. You agree to indemnify, defend, and hold harmless The Hiring Academy, LLC, its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Tools; (b) your hiring, employment, or termination decisions; (c) your failure to comply with applicable employment laws; or (d) any third-party claim related to your employment practices.
